These Terms apply to all users of our platform, including both personal trainers and customers seeking fitness services. If you do not agree to these Terms, please discontinue use of our platform.

1. Acceptance of Terms

By accessing or using Bodyfuelup, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with any other guidelines, policies, or disclaimers referenced herein. If you disagree with any part of these Terms, you may not access or use the platform.

2. Eligibility and User Accounts

Open Access: The website is open to users of all ages.

Account Creation: Trainers may create a profile, while customers can freely browse the site with or without registration.

Prohibited Behavior: Spam, including excessive messages or unsolicited emails to customers or trainers, is strictly prohibited and may result in account suspension or termination.

3. Subscriptions and Payment Terms

Monthly Billing: Trainers are billed €50 monthly to maintain their profile on the site.

Non-Payment Policy: Failure to pay the monthly subscription will result in the profile being moved to “Draft” status, making it invisible to customers. Profiles in “Draft” will be deleted after 60 days of non-payment.

Refunds: Refunds will only be issued if we decline a trainer’s profile due to unsuccessful verification of their certification or credentials.

4. Acceptable Use and Conduct

All users agree to use Bodyfuelup responsibly and with integrity. Trainers and customers are expected to respect the following rules:

Accurate Information: Trainers must provide accurate information, including but not limited to qualifications, certifications, and experience. Misrepresentation of qualifications will result in immediate account suspension or termination.

Respectful Behavior: Users are expected to interact respectfully with each other. Abuse, harassment, or any form of inappropriate behavior may lead to a ban from the site.

Spamming Prohibited: Unsolicited messages, spam, or bulk emails are not allowed. Violations will result in the immediate suspension or termination of accounts.

Compliance with Laws: Users must comply with all applicable local, and government laws and regulations when using Bodyfuelup.

5. User Content and Intellectual Property

User Content: Trainers retain ownership of the content they post, including profile information and images. However, by uploading content to Bodyfuelup, trainers grant us a license to use this content as outlined in Section 6 below.

Intellectual Property: Bodyfuelup retains ownership of all other content on the website, including logos, designs, and other proprietary materials. Unauthorized use of our intellectual property is strictly prohibited.

6. License for Advertising Content

Trainers consent to Bodyfuelup using their photos, images, and other profile content for marketing and advertising purposes, including but not limited to social media advertising. Trainers may withdraw this consent by notifying us through email at: [email protected], and we will make reasonable efforts to cease future use of their images in new advertising materials.

7. Disclaimers and Limitation of Liability

Please review our Disclaimer (link to Disclaimer page) for a full outline of the limitations of liability for both trainers and customers. This disclaimer clarifies that Bodyfuelup is not liable for any injury, accident, dispute, or third-party conduct arising from interactions between trainers and customers.

8. Privacy Policy

Our use of personal information is governed by our Privacy Policy, which will be available on our website. Please refer to our Privacy Policy to understand how we collect, use, and protect your data.

9. Termination of Access

Bodyfuelup reserves the right to suspend or terminate access to any user who violates these Terms, including but not limited to:

Spamming: Unsolicited communication with trainers or customers, or excessive posting in the request feed, may result in immediate suspension or termination.

Misrepresentation: Providing false or misleading information on qualifications, certifications, or experience.

Inappropriate Conduct: Abusive, harassing, nude content or unprofessional behavior toward other users or staff.

10. Modifications to Terms

Bodyfuelup reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting on the website. Users are encouraged to review these Terms periodically to stay informed of any updates. Continued use of the platform following modifications constitutes acceptance of the revised Terms.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Cyprus. Any disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts in Cyprus.
